In consideration for my participation, if accepted, as a charity team member The Kita Center/ Camp Kita during the 2024 Boston Marathon (“the Event”) and with the understanding that my participation is only on the condition that I execute this waiver, for myself, my next of kin, my heirs, administrators, executors and assignees (collectively, “Releasors”), I hereby assume the inherent and extraordinary risks involved in my participation in “the Event” and any risks inherent in any other activities connected with “the Event” in which I may voluntarily participate. I understand that I may participate in “the Event” in the following way as an in-person runner on April 15, 2024 as further described below. I further agree to abide by the Center for Disease Control’s (CDC) recommendations for the prevention of the spread of the Novel Coronavirus Disease (COVID-19) and other communicable diseases, and I attest to have read the CDC’s guidance at: https://www.who.int/emergencies/diseases/novel-coronavirus-2019/covid-19-vaccines. I agree that if the B.A.A., my state or my community deem “the Event” unsafe or has a shelter in place order, that I will not run outside in the community during the duration of a shelter in place order.
I acknowledge that I am participating in “the Event” by my own free will and at my own personal risk.
By providing the electronic equivalent of my signature below, I certify that I am physically fit, have sufficiently trained for participation in strenuous physical activities, and have not been advised otherwise by a qualified and licensed medical professional. I understand that it is also my responsibility to reduce the intensity or stop exercise during “the Event” when it would be reasonable to do so. I agree to abide by any decision of a race official relative to any aspect of my participation in “the Event”, including the right of any official to deny or suspend my participation for any reason whatsoever.
I acknowledge that running a road race is a potentially hazardous activity, which could cause injury or death. I will not enter and participate unless I am medically able and properly trained and certify that I am medically able to participate safely in “the Event”, am in good health, and am properly trained. I attest that I have read the rules of the race and agree to abide by them. I assume all risks associated with running in this event, including but not limited to: falls, physical contact with other participants, volunteers, race personnel, contract service providers, employees, and spectators including the potential for the contraction of a communicable disease resulting from contact with other participants, volunteers, race personnel, contract service providers, employees, and spectators. I assume all risks including, but not limited to, the effects of the weather; high heat and/or humidity; freezing cold temperatures; traffic and the conditions of the road including surrounding terrain.
I understand that the B.A.A. sets forth all rules which I must follow in connection with “the Event”. I understand that I am not allowed to participate in “the Event” with any of the following: bicycles, skateboards, baby joggers/strollers, roller skates or inline skates, animals, and personal music players, or any additional items as designated by the B.A.A. I further agree to abide by all race rules of the Boston Marathon in the cities and towns of Hopkinton, Ashland, Framingham, Natick, Wellesley, Newton, Brookline, and Boston.
I expressly assume the risk of and accept full responsibility for any and all injuries, including death and accidents which may occur as a result of my participation in “the Event”. In addition, I, for myself, my heirs and assignees, hold harmless and release from liability, The Kita Center/ Camp Kita, and its affiliates, and their agents, employees, volunteers, consultants, Trustees, officers, Event partners and sponsors, and successors and assigns (collectively, "Releasees") from any and all claims, demands, debts, suits, losses, damages, fines, penalties, liabilities, costs and expenses, including attorneys’ fees, expenses, court costs, or causes of action whatsoever of every name and nature, both in law and in equity, to any person or property arising from or claimed to have arisen from my participation in “the Event”, including but not limited to my associated training and preparation, or travel to and from “the Event” or any activities associated with “the Event”. I waive any and all claims against the Releasees for any loss or damage (by theft, damage or otherwise) to any of my property, and the Releasees shall have no obligation to safeguard or secure my property. I hereby further waive any claim I may have hereafter as a result of my participation in “the Event” and in any other activities connected with “the Event” in which I may voluntarily participate.
I certify that I carry paid up health and accident insurance coverage that will be in effect during “the Event”.
Photo, Video and Sound Recording Consent and Release: I voluntarily give my permission to The Kita Center/ Camp Kita to take and use photographs, video, and/or sound recordings of me during and in connection with “the Event” (“Images”) and understand that I will not receive any compensation for such use now or in the future. All right, title and interest in the Images belong to The Kita Center/ Camp Kita and I understand that the organization may use the Images in any manner or media, in whole or in part, alone or with other recordings for any educational, promotional, fundraising, or any other purpose that is in furtherance of its charitable mission. Fundraising Commitment: As a condition of being granted our charity entries by the B.A.A. and Bank of America, a commitment of $8,500 is required to join The Kita Center/ Camp Kita’s marathon team and receive an individual entry for the 2024 Boston Marathon®.
Valid credit card information must be included with your application to apply for the The Kita Center/ Camp Kita team. The minimum fundraising requirement must be met by each runner by the date of the marathon, April 15, 2024. The Kita Center/ Camp Kita reserves the right to charge your credit card for the delinquent balance on Monday, April 15, 2024 or if I withdraw from the program after January 1, 2024. I understand that if accepted, I am solely responsible for raising or personally giving the minimum commitment of $8,500 even if for any reason, including injury or event cancellation, I am unable to run 2024 Boston Marathon.
The Kita Center/ Camp Kita also reserves the right to withhold your charity number, and thus exclude you from running the 2023 Boston Marathon if your obligation to the program has not been satisfactorily completed.
In return for his/her receipt of the Entry from The Kita Center, the recruited Entrant will agree to donate and/or fundraise the minimum commitment amount for the benefit of The Kita Center/Camp Kita.
GivenGain: I understand that I must use GivenGain as my exclusive online charitable fundraising platform for the 2024 Boston Marathon.
B.A.A Running and Registration: For purposes of clarity, each runner entrant that has been selected will be required to register themselves for the Marathon; pay all applicable Marathon application processing and entry fees charged by the Boston Athletic Association (the “A.A.”) in connection with registering for the Marathon (the “Marathon Fees”); and agree to all waivers and terms and conditions required by the B.A.A. Any violations of these terms and conditions will result in disqualification of the entrant.
I understand that all funds raised will support The Kita Center/ Camp Kita and that an additional Boston Marathon Application (B.A.A.) fee of $375 (plus optional insurance) will also be required, payable to the Boston Athletic Association. I understand that the B.A.A. application fee does not count toward my total fundraising amount.
The Kita Center/ Camp Kita will inform me of the details of B.A.A. registration. This fee will be collected separately at a later date. I will not contact the B.A.A. directly to secure my number.
I agree that I will not begin the race prior to the official start time; I will not compete in a manner which, in the judgment of the race officials, interferes with race operations or other participants; I will not reproduce or transfer my official bib number.
I confirm that I will train to be able to complete the Boston Marathon (26.2 miles) within six hours.
Cancellation Policy: I understand that I may cancel my participation with The Kita Center/ Camp Kita for the 2024 Boston Marathon, waiving my responsibility for the fundraising minimum stated above, any time on or before January 1, 2024 by contacting Sydney Mosher at The Kita Center/ Camp Kita in writing by email (email@example.com). I understand that any donations received by The Kita Center/ Camp Kita will not be refunded. I understand that after January 1, 2024, I am solely responsible for raising or personally giving the entire fundraising minimum, even if for any reason, including injury, I am unable to run in the 2024 Boston Marathon. I understand that I must register myself to the marathon no later than January 26, 2024.
I understand that this agreement is valid for the 2024 Program only and may be terminated by the B.A.A. at any time.
